Terms and Privacy

These Terms & Condition (Terms) are effective as of 1st June 2019, and govern the terms under which you may use this website and the services associated with it. Do not access or use the Service if you do not agree to be bound by the terms. By accessing and using the Service you are agreeing to the terms. The act of registration and the use of the remittance facility mean that the registered user accepts and is bound by this agreement.

ACCESS & SERVICES

Eligible Users.
You must be at least 18 years old to access or use the Service. You must be able to form legally binding contracts under applicable law. You must have a valid postal address and e-mail address. Other restrictions may apply.

1.Offer and Acceptance.
If you submit a Transaction, you are requesting that we process your Transaction, an offer which we may accept or reject at our sole discretion from our place of business.

2.Registering with us.You must be registered with us to enable you to make a transaction. To get registered, you must provide complete and correct information about yourself sufficient to verify your identity either Passport or Photo Driving licence. Kanson Services reserve the right to accept or reject your registration.

3.Terms of the Registration.
The website is not a deposit account. All deposits taken by Kanson Services are for the sole purpose of money transfer.

For each Transaction that you submit, you agree to pay us a transfer fee plus the Transaction Amount. These fees will be shown to you via the calculator provided. Cleared payment in account is required before transaction can be paid out.

Can be affected to Kanson Services account by either online or telephone banking only from your account.

1.Foreign Exchange.
Kanson Services update the exchange rate on a regular basis and reserve the right to change the rate at any time. Payment amounts are calculated according to the exchange rate at the time of transaction.

2. Cancelling or Refund of Payments.
In the event a transaction has to be cancelled or refunded Kanson Services will refund the amount less the Transfer Fee.

DESTINATION PAYOUT

1.Payout Methods.
Funds are delivered to the Beneficiary in the manner that the registered user specify ,either Cash Pick Up or Payment into Bank Account or Mobile Wallet . For cash pick up, recipient must have a valid locally accepted identity card. It is your responsibility to make sure your recipients have the necessary documents to make collection.

2. Payment time.
Kanson Services general policy is that funds paid into our bank account for the purposes of a money transfer instruction will be processed and available for collection by your beneficiary on the day of receipt of funds for specific destinations otherwise payment will be affected next day. It may take several days for funds to be actually received by us depending on the payment method you select. Funds are not considered received by Kanson Services until they are designated by our bank as cleared funds. There may be additional time to disburse those funds to the Beneficiary. This may arise where we require additional checks to verify your identity, the identity of your Recipient and other AML compliance checks. Payout will not occur until these verification procedures have been completed. You agree that Kanson Services is not liable for any and all claims and bears no liability for losses arising out of the delay or non payment to designated recipients.

RESTRICTIONS

1.General.
We may atour sole discretion refuse any Transaction or limit the amount to be transferred, either on a per transaction basis or on an aggregated basis. We reserve the right at any time, and from time to time to modify or discontinue the Service with or without notice.

2.Transaction Limits.
Kanson Services limits your ability to initiate Transactions with a set of caps on the amount of individual Transactions and the aggregate amount of Transactions that you may initiate in a period of time. These limits vary with several factors, including verification checks how long you have been an registered user, and how many other transactions you have initiated recently. Kanson Services may grant limited exceptions to these restrictions on a case-by-case basis where customers provide additional information about themselves their source of funds and the purpose of their Transactions. The Limits can be changed at any time.

Where a single transaction or the total aggregate value of your transactions in any 30 day period exceeds the pound sterling equivalent of €1,000.00 (including any fee), you will be required to provide an original form of valid ID. 

Where a single transaction or the total aggregate value of your transactions in any 30 day period exceeds £4,000.00 (including any fee), you will be required to provide an original form of valid ID and an explanation of the source of those funds.

Where a single transaction or the total aggregate value of your transactions in any 30 day period exceeds £5,000.00 (including any fee) you will be required to provide an original form of valid ID an explanation of the source of those funds and proof of the source of those funds. I.E Employee Pay slip, Bank Statements.

3.Unauthorized Transactions.
You may not use the Service in violation of these Terms or applicable laws, rules and regulations, including but not limited to rules and regulations relating to money laundering, illegal gambling activities, fraud, and the funding of terrorist organizations.

Commercial Transactions.
We have no control over, and are not responsible for, the quality, safety, legality, or delivery of goods or services that you pay third parties for using the Service. You acknowledge that any use of the Service to pay for such goods and services is at your own risk.

Others.
You may not submit or receive a Transaction on behalf of another person or entity.

COLLECTION OF INFORMATION

1.Privacy Policy.
 By agreeing to these Terms, you acknowledge and consent to Kanson Services Privacy Policy as outlined below.

2.Disclosure.
 You should be aware that if we are requested or required by the police or any regulatory or government authority investigating suspected illegal activities or upon the receipt of a court order, to provide your Personal Information and/or information concerning your activities whilst using our service we shall do so and we reserve the right in our reasonable discretion to disclose details of your use of the services in relation to any or any threatened Court Proceedings in connection with your use or the use of anyone under your control of the service whether in connection with the matters set out in these Conditions or otherwise.

3.Government Disclosures. 
We may provide information about you and your Transactions to government authorities and enforcement agencies as described in our Privacy Policy.

  • Address & Identity Verification.
    We are required by law to verify Identifications sent to us. We will use your Identification details for us to get verification from reputable verifying agencies.You can rest assured that this is done only to confirm your identity, that a credit check is not performed and that your credit rating will be unaffected. All information provided by you will be treated securely and strictly in accordance with the Data Protection Act 1998.
  • Responsibility.
    Customers are responsible to ensure that the details provided at registration (address, telephone number, email, Identification documents(when they expire) etc.)are kept up to date. Kanson Services reserves the right to request further information about clients at any time. Failure to supply such information may result in limitation on usage of this service.

INDEMNITY

You agree to indemnify and hold Kanson Services, Providers, and their respective subsidiaries, officers, agents, partners, and employees harmless from any claim or demand, including reasonable solicitor’s fees, made by any third party due to or arising out of your use of the Service, your connection to the Service.

LIMITATION OF LIABILITY

In no event shall Kanson Services, Service Providers, or their respective subsidiaries, officers, agents, partners, or employees be liable for any direct, indirect, incidental, special, consequential or exemplary damages beyond the sum of £500.00 including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses resulting from any act or omission (whether negligent or otherwise) on the part of Kanson Services, disbursement partners, officers, agents, partners ,or employees.

GOVERNING LAW

These Terms and Conditions and all matters arising from or connected with them are governed by English law. The courts of England have exclusive jurisdiction to settle any dispute arising from or connected with these Terms and Conditions (including a dispute regarding their existence, validity or termination or relating to any non-contractual or other obligation arising out of or in connection with them) or the consequences of their nullity.

TERMINATION.

We reserve the right to terminate your ability to use the Service for any reason and may cancel any pending Transaction. Suspension or termination may occur if  Kanson Services determines 

1.You have not properly funded a requested Transaction;

2.You attempt to initiate a Transaction from an account that does not belong to you;

  • you use the Service, directly or indirectly, for any Forbidden Transaction; 
  • you provide incorrect or false information about yourself, your accounts or about a Recipient.

You understand Kanson Services may report suspicious activity to appropriate law enforcement authorities. Upon termination of your ability to initiate a Transaction for any reason, Kanson Services may terminate all your pending Transactions. If you have no outstanding obligations in connection with the Service, the Bank may credit any balance to any Funding Mechanism that you used to fund Transactions. Termination of this Terms will not affect your liability related to acts or omissions prior to termination, including your liability for any Transaction.

1.How to make a complaint

You can make a complaint by a means that is convenient for you – for example, letter, fax, email, telephone or in person, to any member of our staff, although it may be easier for you to contact your usual dealer.

The quickest way is to email: info@kansonservices.co.uk. This email address is monitored during UK office hours and will ensure that we can begin investigating your complaint as soon as possible.

The complaint will be recorded on our systems, and the person handling it will respond in writing by post or email within 3 business days acknowledging receipt and giving you their contact details, name and position.

We will start investigating your complaint as soon as possible and aim to resolve the matter as quickly as we can, keeping you regularly informed of our progress. In our final response, we will explain our assessment of the complaint to you, along with any remedial action or redress. We will also take measures to improve any systems or processes where necessary.

If eight weeks have passed since you first raised your complaint and you have not received our final response, or you are not satisfied with our decision, you may have the right to refer your complaint to the Financial Ombudsman Service (Ombudsman).
